Where did the $1.6 BILLION in CARES Act money issued to the State of Colorado go?
Great question! Nobody knows except Emperor Polis! He usurped our State Legislature and commandeered these funds to be spent as he saw fit! Interestingly, our legislators were then forced to re-formulate a budget that was already extra lean due to reduced annual revenues. Why did the legislators not file suit against Polis for this unlawful act against We, The People? That's another great question with NO ANSWER!
It is long past time to hold our officials accountable, starting with Lord Polis first! Write them a letter and ask:
What are you doing?
By what law are you doing this? There is NO law, so you are engaging in criminal activity against The People. Anything repugnant to the Constitution is a crime.
By what authority are you doing this?
You committed terrorism & tyranny against the freedom of The People and the Constitution-- you are warring against the Constitution.
Why didn't you stand by your oath?
You are fighting for the Communists. Why are you upholding socialist ideals?
You are attempting to destroy our nation!
Do you realize we can sue you in your private capacity? We do not consent!
Are you a business owner who has suffered at the hands of this tyrant? Do you realize that according to the 5th Amendment of the Constitution of America, your business cannot be taken WITHOUT JUST COMPENSATION? Even to cope with a disaster emergency?
The Colorado Constitution and the Colorado Revised Statutes (C.R.S.) both reiterate the same concept-- a cord of three strands cannot be broken! Polis has incriminated himself THREEFOLD by violating your inherent, unalienable rights to Life, Liberty and Property. Your Property is equivalent to your Life-- you cannot eat if you cannot work. You cannot work if the Governor closes your business to "flatten the curve" or "slow the spread" of SARS-COV-2. According to multiple laws, he cannot take close your business without just compensation:
Colorado Constitution, Section 15, Article 2. TAKING PROPERTY FOR PUBLIC USE - COMPENSATION, HOW ASCERTAINED
Private property shall not be taken or damaged, for public or private use, without just compensation. Such compensation shall be ascertained by a board of commissioners, of not less than three freeholders, or by a jury, when required by the owner of the property, in such manner as may be prescribed by law, and until the same shall be paid to the owner, or into court for the owner, the property shall not be needlessly disturbed, or the proprietary rights of the owner therein divested; and whenever an attempt is made to take private property for a use alleged to be public, the question whether the contemplated use be really public shall be a judicial question, and determined as such without regard to any legislative assertion that the use is public.
C.R.S. 24-33.5-704. The governor and disaster emergencies - response - duties and limitations
(7) In addition to any other powers conferred upon the governor by law, the governor may:
(a) Suspend the provisions of any regulatory statute prescribing the procedures for conduct of state business or the orders, rules, or regulations of any state agency, if strict compliance with the provisions of any statute, order, rule, or regulation would in any way prevent, hinder, or delay necessary action in coping with the emergency;
(b) Utilize all available resources of the state government and of each political subdivision of the state as reasonably necessary to cope with the disaster emergency;
(c) Transfer the direction, personnel, or functions of state departments and agencies or units thereof for the purpose of performing or facilitating emergency services;
(d) Subject to any applicable requirements for compensation under section 24-33.5-711, commandeer or utilize any private property if the governor finds this necessary to cope with the disaster emergency;
24-33.5-711. Compensation - liability when combating grasshopper infestation
(3) Compensation for property shall be made only if the property was commandeered or otherwise used in coping with a disaster emergency and its use or destruction was ordered by the governor or a member of the disaster emergency forces of this state.
(4) The amount of compensation shall be calculated in the same manner as compensation due for taking of property pursuant to eminent domain procedures, as provided in articles 1 to 7 of title 38, C.R.S.
C.R.S. 38-1-101. Compensation - public use - commission - jury - court - prohibition on elimination of nonconforming uses or nonconforming property design by amortization - limitation on extraterritorial condemnation by municipalities - definitions
(1) (a) Notwithstanding any other provision of law, in order to protect property rights, without the consent of the owner of the property, private property shall not be taken or damaged by the state or any political subdivision for a public or private use without just compensation.
"Well," naysayers might say, "he hasn't TAKEN your property." Oh really? Isn't telling you to close your business the same as taking it from you? Isn't forcing you to operate at a reduced capacity the same as taking away a piece of your property? What if Polis ruled that you cannot occupy or enjoy your home during the "pandemic?" You would be homeless! Now instead, you are jobless... or on the verge of joblessness.
But isn't it justified for "the good of society?"
How does your joblessness benefit society?
How does the loss of 10,000 businesses here in Colorado benefit society?
How does the collateral damage of mental and emotional stress on you and your family, depression, suicide and poverty benefit society?
ANSWER: IT DOESN'T!
“Necessity is the plea for every infringement of human freedom. It is the argument of tyrants. It is the creed of slaves.” ~William Pitt, The Younger (1783)
It is sufficiently obvious, that persons and property are the two great subjects on which Governments are to act; and that the rights of persons, and the rights of property, are the objects, for the protection of which Government was instituted. These rights cannot well be separated. The personal right to acquire property, which is a natural right, gives to property, when acquired, a right to protection, as a social right. ~James Madison, “Address at the Virginia Convention”
Our Founding Fathers shed their blood for the right to acquire and secure property. And they would undoubtedly shed their blood again for that same right! Read James Madison's short essay on Property to learn more about what the writers of the Constitution thought about property. Also read what the people of England knew about the pattern of tyranny as a result of studying history from over the course of the previous 700 years: The Grand Remonstrance of 1641. Sound familiar? We need to learn from our ancestors! As stated by Tom DeWeese of the American Policy Center (APC), "Private property is the key to ending poverty." The APC is dedicated to stopping the enforcement of Agenda 21 in order to preserve American property rights. Tom went on to found another organization called the International Property Rights Association (IPRA) which is dedicated to preserving and protecting property rights worldwide. On the other hand, Klaus Schwab, the founder of the World Economic Forum and the mastermind Agenda 21 & 2030 wants us to believe that we will be happy when he has his way and we own nothing! Who do you believe? I vote for Madison!
Open up, Business Owners! Exercise your rights!
Write affidavits against your officials, and hold them responsible for your losses in their PERSONAL AND OFFICIAL capacities. If Polis thinks he can UNLAWFULLY take your property from you, then enforce the Constitution and LAWFULLY take his property from him! He has millions to spare after all! And it is your duty to enforce the Constitution, otherwise tyrants will continue to rage. "When governments fear the people, there is liberty. When the people fear the government, there is tyranny."
Next week, we will talk about more steps we can take together to reverse the tyranny in order to restore and protect the inviolable right to property ownership.
